Acceptance of Terms
These Driver Terms of Use ("Terms") constitute a legally binding agreement between you ("Driver", "you", or "your") and Kose Africa (Pvt) Ltd, a subsidiary of Zano Money (Pvt) Ltd ("Kose", "we", "our", or "us") governing your access to and use of the Kose Driver App, platform, and associated services (collectively, the "Platform").
By registering as a driver on the Kose platform, completing the onboarding process, or activating your driver account, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Driver Privacy Policy and any supplementary guidelines or policies published on the Platform.
Nature of Relationship
You are an independent contractor, not an employee, agent, partner, or joint venture partner of Kose. Nothing in these Terms creates any employment relationship, and Kose does not control the manner or means by which you perform transportation services.
As an independent contractor, you are solely responsible for:
- Determining your own working hours and availability on the platform
- Paying all applicable income tax, VAT, and other statutory levies on your earnings
- Obtaining and maintaining all licences, permits, and insurance required by law
- Complying with all applicable transport, labour, and tax regulations in your country
Kose provides a technology platform that connects drivers with riders and does not provide transportation services directly. Kose is not responsible for the actions or omissions of drivers in the performance of transportation services.
Eligibility and Registration
To register and remain active as a Kose driver, you must at all times meet the following requirements:
3.1 Personal Eligibility
- Be at least 21 years of age
- Hold a valid driver's licence issued in your country of operation with the appropriate class for the vehicle you intend to use
- Have held a driver's licence for a minimum of 2 years
- Pass Kose's identity verification and background check process
- Not have any disqualifying criminal convictions, particularly those involving violence, sexual offences, or serious traffic violations
- Have a valid and active mobile money or bank account for earnings disbursement
3.2 Accuracy of Information
You must provide accurate, complete, and up-to-date information during registration and throughout your time on the platform. You must notify Kose immediately of any change to your licence status, vehicle details, insurance, or contact information. Providing false or misleading information is grounds for immediate deactivation.
Vehicle Requirements
All vehicles used on the Kose platform must meet the following minimum standards at all times:
4.1 General Requirements
- Be roadworthy and hold a valid certificate of fitness or equivalent document as required by law
- Have valid third-party liability insurance at a minimum, with comprehensive cover strongly recommended
- Be registered in your name or authorised for commercial use in your name by the registered owner
- Not be older than 10 years from the date of first registration (subject to service tier requirements)
- Have functioning air conditioning, seatbelts on all seats, and a clean interior
- Meet any additional specifications required for the service tier you are registered under (Go, Plus, Lux, or XL)
4.2 Service Tier Standards
- Kose Go: Standard sedan or hatchback; minimum 4 passenger seats; good condition
- Kose Plus: Mid-range or full-size sedan; newer model; higher cleanliness standards
- Kose Lux: Premium or luxury vehicle; leather interior; impeccable presentation required
- Kose XL: SUV or minivan; minimum 6 passenger seats; full luggage capacity
Kose reserves the right to inspect your vehicle at any time and to downgrade or suspend your account if your vehicle fails to meet applicable standards.
Platform Access and Use
5.1 Driver Account
Your Kose driver account is personal to you and may not be shared, transferred, or used by any other person. You are responsible for maintaining the security of your login credentials. If you suspect unauthorised access to your account, notify Kose support immediately.
5.2 Going Online
By setting yourself to "online" in the driver app, you represent that you are physically present in your vehicle, in an appropriate condition to drive, and available to accept trip requests. You must not go online if you are unwell, fatigued, or impaired in any way.
5.3 Trip Requests
You are free to accept or decline trip requests at your discretion. However, consistently declining trips without reason may affect your standing on the platform. Kose reserves the right to set minimum acceptance rate guidelines, which will be communicated to you through the app.
Trips and Service Standards
6.1 During a Trip
- Arrive at the pickup location promptly and confirm the rider's identity before departure
- Follow the route suggested by the navigation system or the shortest reasonable route to the destination
- Drive safely, lawfully, and in accordance with all applicable road traffic laws
- Maintain a professional, courteous, and respectful demeanour toward riders at all times
- Not use a handheld mobile phone while driving
- Not pick up additional passengers not booked through the platform without the rider's express consent
- Not deviate from the agreed route without the rider's consent or a safety-related reason
6.2 Cancellations
Once you have accepted a trip, you should complete it unless there is a legitimate reason to cancel, such as a safety concern or force majeure. Repeated or unexplained cancellations after acceptance will negatively affect your rating and may result in platform restrictions.
6.3 Lost Property
If a rider leaves property in your vehicle, you must make reasonable efforts to return it. You may charge a return fee as specified in the Kose Driver Guidelines. You must not appropriate, use, or dispose of rider property.
Fares, Earnings and Payments
7.1 Fare Calculation
Fares are calculated by Kose's pricing algorithm based on distance, time, demand, and applicable surcharges. Kose reserves the right to adjust fare structures at any time, with notice provided through the driver app. You must charge riders the fare displayed in the app and may not demand additional payment outside the platform.
7.2 Platform Commission
Kose deducts a platform commission from each trip fare before disbursing your earnings. The applicable commission rate is displayed in your driver app and may vary by service tier, market, or incentive programme. Kose reserves the right to revise commission rates with reasonable advance notice.
7.3 Disbursement
Earnings are disbursed to your registered mobile money or bank account on the schedule displayed in the driver app (daily or weekly). Kose is not responsible for delays caused by payment processors, mobile network operators, or banking institutions.
7.4 Disputes
If you believe there is an error in your earnings or a fare calculation, you must raise a dispute through the driver app within 14 days of the relevant trip. Kose will investigate and respond within 7 business days.
Ratings and Performance
Riders are invited to rate every trip on a scale of 1 to 5 stars. Your aggregate driver rating is calculated from these scores and is visible to riders when you are matched with them.
- A minimum rating threshold applies to remain active on the platform — the current threshold is communicated in the driver app
- Drivers falling below the threshold will be notified and given a reasonable period to improve
- Persistent failure to meet the minimum rating may result in temporary suspension or deactivation
- You may contact Driver Support to query specific reviews that you believe are fraudulent or in violation of platform policies
Kose also monitors acceptance rates, cancellation rates, and complaint history as part of overall performance assessment. These factors may affect your eligibility for incentive programmes and preferred trip assignments.
Prohibited Conduct
The following conduct is strictly prohibited and will result in immediate suspension or permanent deactivation:
- Soliciting cash payments outside the platform for Kose trips
- Discriminating against riders based on race, gender, religion, disability, or any other protected characteristic
- Using the Kose platform for purposes other than lawful transportation and delivery services
- Recording riders without their knowledge or consent
- Making unauthorised modifications to the driver app or attempting to circumvent platform systems
- Threatening, intimidating, or retaliating against a rider who has submitted a complaint
- Using a GPS spoofing device or software to falsify your location
Safety Obligations
10.1 Your Responsibilities
- Drive at all times in accordance with road traffic laws in your jurisdiction
- Ensure all seatbelts are fastened before commencing each trip
- Not operate the vehicle while fatigued, unwell, or under any form of impairment
- Report any accident, safety incident, or criminal act involving a Kose trip to both local authorities and Kose support within 24 hours
- Complete any mandatory safety training programmes communicated by Kose
10.2 SOS Feature
The Kose Driver App includes an SOS emergency feature that allows you to alert Kose's safety team and share your live location in an emergency. You are encouraged to use this feature if you feel unsafe during a trip. Activating the SOS feature triggers notification to Kose's monitoring team and, where appropriate, emergency services.
10.3 Rider Safety
You must take all reasonable steps to ensure the safety and comfort of riders during trips. If a rider behaves in a threatening or unsafe manner, you may end the trip and report the incident to Kose support immediately. Kose will investigate and take appropriate action.
Insurance
As an independent contractor, you are responsible for maintaining adequate insurance coverage for your vehicle and your activities as a driver. At minimum, you must hold:
- Valid third-party liability insurance as required by law in your country of operation
- Any additional insurance required by local transport regulations for commercial or for-hire use
Kose may partner with insurance providers to offer optional cover products to drivers. Details of any such products will be communicated through the driver app. Participation is voluntary and does not substitute for legally required insurance.
Intellectual Property
Kose grants you a limited, non-exclusive, non-transferable, revocable licence to use the Kose Driver App solely for the purpose of providing transportation services through the platform. This licence does not grant you any right to:
- Copy, modify, distribute, or create derivative works based on the app or platform
- Use Kose's trademarks, logos, or branding outside the app without prior written consent
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use any automated tools or scripts to interact with the platform
All intellectual property rights in the Kose platform, app, branding, and related materials remain the exclusive property of Kose Africa (Pvt) Ltd.
Suspension and Termination
13.1 By Kose
Kose may suspend or permanently deactivate your driver account at any time if:
- You breach any provision of these Terms
- You no longer meet the eligibility or vehicle requirements
- Your rating falls below the minimum threshold after a remediation period
- You are the subject of a credible safety complaint or ongoing investigation
- Kose is required to do so by law or regulatory authority
For non-zero-tolerance violations, Kose will ordinarily provide notice and an opportunity to respond before permanent deactivation, except where immediate suspension is required to protect the safety of riders or others.
13.2 By You
You may terminate your driver partnership at any time by contacting Kose Driver Support and closing your account. Upon termination, your access to the platform will cease. Outstanding earnings at the time of termination will be disbursed on the next regular payment cycle, subject to any outstanding disputes or deductions.
13.3 Effect of Termination
Upon termination, the licence granted to you under Section 12 is immediately revoked. Provisions of these Terms that by their nature should survive termination — including liability, indemnification, and governing law clauses — shall continue to apply.
Liability and Indemnification
14.1 Limitation of Liability
To the fullest extent permitted by applicable law, Kose's aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total platform commission paid to Kose by you in the 3 months preceding the event giving rise to the claim.
Kose shall not be liable for: loss of earnings or income; indirect, consequential, or special loss; interruptions to platform availability; or the acts or omissions of riders, third parties, or external service providers.
14.2 Your Indemnification of Kose
You agree to indemnify, defend, and hold harmless Kose, its directors, officers, employees, and agents from and against any claims, damages, losses, penalties, and costs (including reasonable legal fees) arising from:
- Your breach of these Terms or applicable law
- Your provision of transportation services, including any accident, injury, or damage
- Any misrepresentation made by you during registration or while using the platform
- Your failure to maintain required insurance, licences, or vehicle standards
Governing Law and Disputes
These Terms are governed by the laws of Zimbabwe for drivers operating in Zimbabwe; the laws of Zambia for drivers operating in Zambia; and the laws of the Republic of South Africa for drivers operating in South Africa. The courts of the relevant jurisdiction shall have non-exclusive jurisdiction to resolve any dispute arising from these Terms.
Before commencing any formal legal proceedings, you agree to first attempt to resolve any dispute with Kose through our internal Driver Support process. If a dispute cannot be resolved informally within 30 days, either party may refer the matter to the appropriate dispute resolution forum or court.
Amendments
Kose reserves the right to amend these Terms at any time. When material changes are made, we will notify you via the driver app or email at least 14 days before the changes take effect. If you do not agree with the changes, you must stop using the platform before the effective date. Your continued use of the platform after the effective date constitutes your acceptance of the revised Terms.
